Member of Our said Legislative Council shall die or shall, with Our said Governor's permission, resign his office by writing under his hand, or shall at any time be absent from Our said Colony, or incapable of acting in the exercise of his office, it shall be lawful for Our said Governor to appoint provisionally any fit person to be a Legislative Councillor in place of such member, and so soon as such member shall return to Our said Colony, or shall be declared by Our said Governor to be capable of exercising his office of Legislative Councillor, the person so provisionally appointed shall forthwith cease to be a member of Our said Legislative Council: Provided also, that the appointment by Our said Governor of any Unofficial Member of Our said Legislative Council shall be forthwith signified to Us, and shall be provisionally in force until the same shall have been confirmed or disallowed by Us through one of Our Principal Secretaries of State, and that every member of Our said Legislative Council shall hold his office during Our pleasure, and that the number of Unofficial Members resident in Our said Colony, and capable of acting in the exercise of their offices, shall at no time exceed Six.

XIII. And We do further declare Our pleasure to be that the Official Members of Our Executive and Legislative Councils shall take precedence of the Unofficial Members, and shall take rank among themselves as follows: First, the Senior Military Officer for the time being in command of Our Regular Troops within Our said Colony (except that the said Senior Military Officer, if he be below the rank of Colonel or Lieutenant-Colonel in Our Army, shall take precedence in Our said Councils, respectively, next after the person lawfully discharging the functions of Chief Justice, and if he be below the rank of Major General in Our Army, next after the person lawfully discharging the functions of Attorney-General in Our said Colony), and the person for the time being lawfully discharging the functions of Colonial Secretary and of Attorney-General of Our said Colony in the order herein named; and, afterwards, the Official Members in the order of their appointment; or if appointed by the same Instrument, according to the order in which they are named therein.

But Councillors appointed by Us shall in all cases rank before Councillors provisionally appointed by Our said Governor.

The Unofficial Members shall take rank according to the date of their appointment, or if appointed by the same Instrument, according to the order in which they are named therein.

XIV. And We do further authorize and require Our said Governor to frame and propose to Our said Legislative Council for their adoption, and, with the advice of Our said Legislative Council, from time to time to make, alter, revoke, and renew such standing rules and orders as may be necessary to ensure punctuality of attendance of the members of Our said Legislative Council, and to prevent meetings of Our said Council being held without convenient notice to the several members thereof, and to maintain order and method in the dispatch of business, and in the conduct of all debates in Our said Legislative Council, and to secure due deliberation in the passing of laws, and to provide that before the passing of any law intended to affect the interests of private persons, due notice of the same is given to all persons concerned therein, all which rules and orders, not being repugnant to Our said Charter and Letters Patent, or to these Our Instructions, or to any other Instructions which you may receive from Us, shall at all times be observed.
